how soon should an employer have to fix a payroll error where they short an employees pay....

My employer (ontario, canada) messed up my pay last pay day they shorted me close to $600 for no good reason at all. I brought it to their attention immediately before they had even submitted it to be direct deposited and was advised it would be fixed on my next pay (bi-weekly pay schedule) this was confirmed in writing by the payroll clerks manager in email. Today is the date they do payroll again for our pay next friday. I emailed the payroll clerk this morning to ensure that she had in fact corrected it and she emailed me back stating she only does corrections once per month on the first pay of the month so I now have to wait until 08/05/11 to get my pay I should have gotten 4 weeks before that..... Is that even legal..... and to top it off the screwed up this one too in the same damn way. I need to pay my bills any advice?

If it was a small error, I could see them waiting until the nest pay period to fix it. However, $600 is a big deal and that should have been fixed right away in my opinion. Especially if you brought it to their attention before they even did your direct deposit. I would be fuming if I were you. I'm not sure if it is legal or not. It might depend on the laws of your state. If you have not been compensated yet, I would maybe consult the Better Business Bureau and see if they can give you any information on what to do about it. This makes me wonder if the company you work for is having financial issues. Similar things to this happened to me and many other at the place I used to work at. That company had serious issues.

i do not know canadian employment laws. in usa we would go to payroll clerk then human resources the go to state consumer/worker agency

I wonder about legalities but I think it's just an awful policy decision. I would have hoped your plight would be acknowledged and as a courtesy they would fix it in a matter of days. This is the only idea, but if it stands as is, maybe a letter of explanation from them about procedures, in-hand dates and whatever could help you with a bill (ext. due date with no penalty, etc.) I have bever heard of this when it was their mistake.

That is a lot of money you are owed! In the United States I believe it needs to be fixed and shown in the next pay period once the error is realized. I would send weekly reminders or inquiries on the status to the person that is responsible for rectifying this situation. I would also send them to my supervisor and this person's immediate supervisor. You may also want to inquire if there is some sort of emergency assistance available from your employer. Your bills need to be paid.

I think that the norm is one pay period, but that should be listed somewhere in your company policies.

I think they have upto ninty days but it should only take one pay period. They have all the rights and I would keep on them if I were you. Good Luck

The same thing happened to me but the rest of the money was on my next cheque.
